is there any UK law on the maximum amount of projection ladders on a van ladder rack can protrude?
I have just reversed my van into a guys ladders protruding from the back of his van. All details have been exchanged and it has been passed onto the insurers.
His ladders are now somewhat bent!!!! He claims he had a piece of high-viz vest hanging from the ladders – but the ladders were protruding approx 5ft out from the back of his Ford Transit van – to me that seems illegal, but I don’t know. if I had a rear end collision with him – I would hate to think what could have happened. I think my head would have got pushed way into the back doors of my van!!!! Please can somebody help with some advice. Thanks.
The Road Traffic Act 1991 Introduced provisions into the Road Traffic Act 1988
A vehicle carrying a load or a vehicle fitted with a special appliance or apparatus that
overhangs the load area may require special markings. If there is a rearward projection
between 1m and 2m the overhang must be made clearly visible to other road users. If there is
a forward or rearward projection exceeding 2m or there is a projection on either side of the
vehicle of more than 305mm or the overall width of a vehicle or any lateral (sideways)
projection exceeds 2.9m then Regulation 82 of The Road Vehicle (Construction and Use)
Regulations 1986 must be complied with. It should be noted that in some circumstances it will
be necessary to notify the police before the vehicle can run on public roads.
Regulation 100 of the Road Vehicle (Construction and Use )act makes it an offence to use a vehicle in a way that would cause a danger to other road users and Section 40 of the Road Traffic Act makes it an offence to use a vehicle in a dangerous condition. This would include the weight, position and distribution of a load or the manner in which it was secured.
You would need to demonstrate that the other vehicle had breached some of the regulations. Also you have a responsibility to check behind you before reversing. If that means you have to get out of your van and physically check, or get someone to check for you then so be it. Rear visibility on most vans is pretty poor, simply glancing in the mirror is not enough. Consider what would have happened if this guy had been unloading when you reversed.
