Disputing an Insurance Claim?
Okay so we had a fire in the garage of our rental property. We have no contents insurance.
My husband was draining fuel from underneath his 4WD. He had the side door and a window to the garage open.
He was working away when all of a sudden fire engulfed him underneath the truck. He tried to put it out with a fire extinguisher. It became obvious this would not work – we rung 111.
The Fire Inspector has since said that the fire started as a result of our freezer starting its cycle and igniting the fumes.
Question: The L/Ls insurance company now say we are liable for all costs. However is states in the Department of Housing website that we can only be held liable if the damage was ‘intentional/careless’.
Well my husband did not try to light himself on fire intentionally, and how were we supposed to know that freezers can ignite fumes?
Can we prove that it was not ‘intentional or carelessness’? Will they make us pay?
Actually, ignorance can be an excuse if to be liable you have to be intentional or careless. Try Tenancy Tribunal or Disputes Tribunal, if they can’t deal with it see a lawyer – Community Law Centre or Citizens Advice Bureau can give limited free advice.
